1. TERMS & CONDITIONS (Website Services Agreement)

These Terms & Conditions (“Terms”) govern every service provided by BKA Digital (“we”, “us”, “our”) to any client (“you”, “your”). By commissioning or using our services you agree to the clauses below.

1.1 Nature of Services

We deliver both free and paid website builds. Free websites still require an active £29.99 per month hosting subscription unless otherwise agreed. Paid custom builds may include additional fees confirmed in writing.

1.2 Ownership of Websites

We retain full ownership of all websites we create—including layout, design, code, templates, and supporting assets—unless a separate signed contract states otherwise. You receive a license to use the website for as long as your hosting or service subscription remains active and in good standing. If payments lapse or you cancel hosting, access may be suspended or permanently removed.

1.3 Client Responsibilities

  • Provide required content, assets, branding, and instructions promptly.
  • Ensure every file supplied is legal, non-infringing, and owned or licensed by you.
  • Respond to requests for feedback or approvals within a reasonable timeframe.
  • Review and approve designs or revisions when requested.

Missing content, unusable files, or unresponsive communication may delay delivery. We are not responsible for deadlines missed due to such delays.

1.4 Project Timelines

Timelines we provide are estimates. Schedules may change if you do not supply assets or approvals, if third-party services fail, or if unforeseen events occur. We are not liable for resulting delays.

1.5 Communication & Conduct

We expect respectful, professional communication. We reserve the right to suspend or cancel services if communication becomes rude, abusive, threatening, or unreasonably demanding. No refund is guaranteed when services end due to misconduct.

1.6 Cancellation by Us

We may cancel or suspend your website or hosting if you fail to pay fees, provide illegal or infringing content, violate these Terms, mistreat our team, or misuse the service. If we cancel before your next billing date you will not be charged again.

1.7 Cancellation by You

You may cancel hosting at any time. Upon cancellation your website is removed from our servers. We do not guarantee delivery of backups or files after cancellation unless we decide to provide them.

1.8 No Guarantees & Limitation of Liability

We do not guarantee increased sales, traffic, search rankings, or flawless performance. We are not liable for loss of income, loss of data, downtime, third-party failures, client misuse, or unauthorised access. Our total liability is limited to the fees you have paid us in the last 30 days and will never exceed the total paid in the 12 months preceding a claim.

1.9 Intellectual Property & Content

You confirm all content you provide is owned by you or licensed for use. You take full responsibility for illegal or copyrighted material supplied. We may refuse content or projects that violate law, policy, or our own discretion, including content that is illegal, offensive, or discriminatory.

1.10 Modifications to Terms

We may update these Terms at any time. Continued use of our services after an update constitutes acceptance of the revised Terms.

User Responsibilities

When using our services, you also agree to:

  • Provide accurate and complete information.
  • Maintain the security of your account credentials.
  • Comply with all applicable laws and regulations.
  • Not use our services for illegal or unauthorised purposes.
  • Not interfere with or disrupt our services or servers.
  • Not transmit malicious code, viruses, or harmful content.

Limitation of Liability

To the fullest extent permitted by law, BKA Digital is not liable for indirect, incidental, special, or consequential damages; loss of profits, revenue, data, or business opportunities; damages from unauthorised access; or damages caused by third-party services. Our total liability shall not exceed the amount paid in the 12 months preceding a claim and is capped at the amount paid in the last 30 days.

Warranties and Disclaimers

Our services are provided “as is” without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted or error-free, that defects will be corrected immediately, that our services will meet your specific requirements, or that results obtained will be accurate or reliable.

2. REFUND & CANCELLATION POLICY

2.1 Refund Eligibility

Refunds are not guaranteed. We may refuse a refund if you fail to provide required content, cause delays through lack of communication, behave rudely or disrespectfully, work has already begun, or hosting has been active for the month. All refunds are at our sole discretion.

2.2 Hosting Fees

Hosting fees of £29.99 per month are non-refundable once the billing cycle begins. Cancelling before the next billing date ensures you are not charged again.

2.3 Service Cancellation by Us

If we cancel services due to client misconduct or rule violations, no refund is guaranteed and restoring the site may require additional fees.

2.4 Files & Access After Cancellation

When service is cancelled your website is removed from our servers. You may not receive backups, files, or assets unless we choose to provide them. Reinstating a cancelled website may incur further charges.
